Film Day is software for content teams. An agency or in-house team (the “Agency”) uses it to plan scripts, book short filming sessions with the people it films (“Clients”), collect the recordings, and manage the finished pieces. These terms are between the Agency and Film Day. A Client who opens a film link is covered by the Client terms in section 7.
The person who creates an Agency account must be entitled to act for that business. The Agency is responsible for everyone it invites and for keeping sign-in details private. Tell us straight away if you believe an account has been used without permission.
Scripts, hooks, recordings, finished pieces and client details belong to the Agency or its Clients, not to Film Day. You give us the limited licence we need to store, process, display and deliver that content to you and to the people you choose, and nothing more. We do not use your content to train models or to promote Film Day.
The Agency is responsible for having the Client’s permission to record, edit and publish footage, and for any consents required where the Client lives. Film Day asks each Client to confirm this before they record, but the Agency remains responsible for how footage is used.
Do not use Film Day for anything unlawful, to film people without their consent, to send unsolicited messages, or to interfere with the service or other accounts. Text messages sent through Film Day must comply with the Spam Act and the equivalent law wherever the recipient is.
Paid plans are billed in advance by card. Fees are shown before you subscribe, in Australian dollars unless stated otherwise, and include GST where it applies. Edit packs are counted by approved pieces. You can cancel at any time; the plan runs to the end of the period already paid.
A film link is personal to the Client it was sent to. By recording, the Client confirms they are happy for the Agency named on the page to edit and publish the footage on their behalf. Recordings are stored for the Agency; Clients can ask the Agency to delete them at any time.
We aim to keep Film Day available at all times but do not guarantee it. Planned maintenance is announced in advance where possible. Support is by email during Australian business hours.
To the extent the law allows, Film Day’s total liability for any claim is limited to the fees you paid in the three months before the claim. Nothing in these terms limits rights that cannot be excluded under the Australian Consumer Law.
You can close your account at any time from Settings. We can suspend or close an account that breaks these terms, with notice where practical. After closure we keep your content for 30 days so you can export it, then delete it.
We may update these terms; material changes are emailed to the account owner at least 14 days before they apply. These terms are governed by the laws of New South Wales, Australia.
